1. SCOPE: These Terms of Use (terms) cover all applications and services hosted on TomsApps.com (collectively referred to as Tom's Apps) which is owned and operated by Tom's Apps, LLC. This includes Astrology Horoscopes & Matches. By using Tom's Apps you accept these terms in full and without reservation. If you disagree with these terms or any part of these terms, you must not use this Tom's Apps.
2. AGE: You are bound by agreeing to these terms to certify you are not under the age of 13 years.
3. USE: You may use Tom's Apps only for personal use. You may not use Tom's Apps in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity. You may not use Tom's Apps to harass, stalk, or otherwise attack other people. You may not post defamatory or hateful material towards any group or individual. You may not post false or misleading information. You may not post offensive or obscene material. You may not disrupt or cause problems with its servers or services or with the usage of it by other users, including but not limited to denial of service attacks or distribution of malicious software. You may not post any material for which you do not own the legal rights. You may not copy material which you did not create including but not limited to scraping and data mining.
4. NO WARRANTIES: Tom's Apps are provided "as is" without any representations or warranties, express or implied. Tom's Apps does not warrant that: Tom's Apps will be constantly available, or available at all; or the information on Tom's Apps is complete, true, accurate or non-misleading. Nothing on Tom's Apps constitutes, or is meant to constitute, advice of any kind. Tom's Apps are for entertainment purposes only. Tom's Apps offers no representation that they have any predictive or meaningful value or information.
4. NO LIABILITIES: Tom's Apps, LLC will not be liable to you in any way in relation to the contents of, or use of, or otherwise in connection with Tom's Apps including, but not limited to: any indirect, special or consequential loss; any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill; loss or corruption of information or data; any private information disclosure, dangerous activity, illegal activity, financial loss, physical harm, and emotional damage. Any dealings with any person or business entity contacted through Tom's Apps is at the full risk of the user. These limitations of liability apply even if Tom's Apps has been expressly advised of the potential loss. You assume full responsibility and liability for your use of Tom's Apps and any violations of any local, national or other laws that may result from it. You agree to indemnify Tom's Apps, LLC from any and all legal claims, losses, damages, costs, liabilities and expenses incurred or suffered that may result from your use of Tom's Apps.
6. ACCOUNTS: You are responsible for safeguarding your account and all its information, including your third-party login information. Tom's Apps reserves the right to terminate any account at any time for any reason.
7. SUBMITTED CONTENT: You grant to Tom's Apps a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute any content (including without limitation text, images, audio material, video material and audio-visual material) which you submit in any existing or future media. Your content must not be illegal or unlawful, must not infringe any third party's legal rights, and must not be capable of giving rise to legal action whether against you or Quiz Maker or a third party. Tom's Apps reserves the right to edit or remove any submitted content. Quiz Maker does not undertake to monitor the submission of such content to, or the publication of such content on Quiz Maker.
8. TRANSFER OF OWNERSHIP: Tom's Apps, LLC reserves the right to transfer ownership and operation of Tom's Apps and any application or services on it to any other party including all submitted material and user account information.
9. CHARGES: Tom's Apps reserves the right to charge any fee for any service currently provided at no cost.
10. LAW AND JURISDICTION: These terms will be governed by and construed in accordance with the laws of New York, USA, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of New York, USA.
11. CHANGES: These terms may change from time to time and you will be bound by the most recent version, which is available at this location. You are advised to review these terms periodically. Changes to these terms are effective when they are posted here.
